Reflections on the full effect adoption in the Romanian legislation for the case in which the adopted person has biological descendants

Summary/Abstract: The Romanian Civil Code has brought significant changes regarding the adoption procedure. Only the full effect adoption is regulated in the current civil legislation. Regarding its effects, especially in the particular case in which the adopted person has descendants prior to his/hers adoption, certain uncommon situations can be identified, situations that are not fully taken into account in the current legislation. In this study, the effects of the adoption are analysed from this perspective, taking into account the national legislation and the relevant international regulations.
