Some aspects regarding the right to a name in light of the new legislative changes

Summary/Abstract: The name as a personal identity attribute is of major importance both from a general and social point of view, through the lens of the legal reports in which a person takes part, and from a more subjective point of view, which involves a series of personal valences related to each individual. The main objective of this paper is to carry out an analysis of the legal provisions regarding the right to a name, with particular emphasis on the legislative changes introduced by Law no. 105/2022 for the amendment and completion of Law no. 119/1996 regarding civil status documents, as well as for the abrogation of Government Ordinance no. 41/2003 on the acquisition and administrative change of the persons names. Through the new normative provisions, the legislator wanted to establish a legislative framework that is clearer and more adapted to today’s society, bringing a series of changes also regarding the establishment of the first name of the person, administrative change of the person’s names etc., changes that were highlighted in the present material by reference to the old regulation.
