Child protection in the context of domestic violence

Summary/Abstract: The phenomenon of domestic violence is becoming ever more common in the courts of justice. Among the direct victims of domestic violence there are many children, who are being physically or psychologically abused by their parents or other family members, and among the indirect victims of domestic violence there are also children who had witnessed acts of violence against their parents or against other family members. Domestic violence is regulated by Law no. 217/2003, which, however, is compiled of a series of outdated provisions that are not adapted to current realities regarding the measures by which the guardianship courts have the possibility to remove the abuse and remedy its consequences on the children victims. Respecting the best interest of the child in the context of domestic violence requires a careful approach that responds to complex challenges, such as the effects generated by violence on the sensitive psyche of children, especially at a young age.
