Summary/Abstract: On September 4, 2020, in Washington, DC, President of the Republic of Serbia Aleksandar Vučić and Prime Minister of so-called Kosovo Avdullah Hoti signed an agreement entitled “Economic Normalization” (the Washington Agreement) in the presence of US President Donald Trump. The Agreement was concluded in an obsolete form which was used in the 17th, 18th and 19th centuries, and which academician Kosta Čavoški associates with the 1648 Peace of Westphalia and the intention of contracting parties to avoid signing their shared document for political, religious, and practical reasons. The Washington Agreement is not an economic agreement, but rather a legally binding international agreement which enables socalled Kosovo to file an application for admission to membership in the United Nations with a one-year deferment period. The Washington Agreement is not a political agreement because, according to academician Milan Bartoš, political agreements are agreements on cooperation, friendship, and support which tie governments, but not states. The Washington Agreement is contrary to international and internal law. The Washington Agreement does not invoke the legally binding United Nations Security Council Resolution 1244 (1999), which stipulates several times that Kosovo and Metohija is part of the Federal Republic of Yugoslavia (Serbia). The Washington Agreement is contrary to the 2006 Constitution of the Republic of Serbia. The Washington Agreement has legal continuity with the non-constitutional and unlawful First Agreement of Principles Governing the Normalization of Relations (the Brussels Agreement). The Washington Agreement is basically a modified version of the Ischinger Plan of 2007. In terms of legal history, it is similar to the secret Austro-Serbian Convention of 1881.
