Summary/Abstract: Тhispaper deals with two initial and key questions regarding enforced disappearance as a crime against humanity – historical development of this legal institute and sources of law related to this crime. In that sense, the paper is divided into two parts. In the first part, the author analyzes the historical development of this legal institute from Nurnberg Trials until now. Second part of this paper refers on sources of law related to this crime. The paper contains chronological overview of the sources of law, firstly, international criminal law’s sources, but also international public law’s sources and human rights law’s sources, which have decisive impact on this incrimination and its development.
