ON SUBMISSION OF THE STATE LEGAL LIABILITY FOR DAMAGES WITH SPECIAL REFERENCE TO THE MOST IMPORTANT THEORETICAL CONCEPTS

Summary/Abstract: The paper investigates the notion of subordinating the state to legal responsibility, with special reference to the most important theoretical concepts that have led to today’s legal solutions. Also, the attitude of the state towards citizens and the influence of the role of the state in society on the regulation of its responsibility are examined. This scientific paper clearly indicates the importance of not only a practical, but also a theoretical view of the institute of legal responsibility of the state, and what harmful consequences lead to neglect, or lack of new theoretical concepts. Namely, it can be freely said that the last theory worth mentioning, and which influenced the practical standardization, dates from the beginning of the 20th century, and that since then no new theory has been created that would give a new look at the institute of legal responsibilities of the state
