POWERS OF THE MUNICIPAL INSPECTION IN THE IMPLEMENTATION OF MEASURES TO PREVENT THE SPREAD OF THE COVID-19 VIRUS

Summary/Abstract: The epidemic of the infectious disease COVID-19 has created the need for the implementation of emergency measures to combat it. A state of emergency was declared in the territory of the City of Nis in November 2020, during which the city authorities acted with the aim of preventing the spread of the COVID-19 virus. The question is which specific powers the members of the communal inspection had in that action. The author first deals with the organization of communal inspection on the territory of the city municipalities of the City of Niš, but also communal militia, bearing in mind that the cooperation of these two bodies is prescribed by legal acts. After that, the author will analyze the legal regulations on the basis of which communal inspectors can act, namely the Law on Inspection Supervision, as the general law and the Law on the Protection of the Population from Infectious Diseases, which contains the powers of communal inspectors to deal with epidemics of greater epidemiological importance on a wider scale. Then we will talk about the provisions of the Government Regulation on measures to prevent and suppress the infectious disease COVID-19 and about local regulations – the Decision on communal inspection on the territory of the City of Niš and the Decision on communal militia. At the end of the paper, there is a tabular presentation with data on the concrete procedures of communal inspections of city municipalities in 2021.
