Summary/Abstract: Although the new civil procedure Code institutes the principle of plenitude of competence of the bailiff regarding the enforcement procedure, it allows through the provisions of article 623 Civil procedural Code for it to be carried out by the institutions that collect incomes to the consolidated budget or the budget of the European Union. This fact is indurated by article 654 Civil procedural Code that establishes the base principles for resolving such an incident. The paper analyzes the situations when a concourse can appear between more than one enforcement procedures, as well as the situations where the concourse appears between the enforcement procedure and the execution initiated by a creditor.
