Summary/Abstract: Ensuring the smooth functioning of the internal market would be impossible without guaranteeing the full functionality of the freedom of movement of persons, goods, services and capital, as well as the freedom to make foreign currency payments related to them. The importance of the historical Luisi and Carbone ECJ jurisprudence resides in the fact that it recognizes in the context of the freedom to provide services the fact, that not only the service providers have the freedom to move on the territory of the member states, but also the beneficiaries of these services. At the same time, the Court noted for the first time that ensuring the freedom of movement of services would be impossible without the collateral guarantee of the payments related to these services. Payments in foreign currency representing consideration for services rendered are not considered capital movements.
