Summary/Abstract: The scientific study examines the issue of the legal nature of education, respectively its duration, as elements of the factual composition generating the right to an inheritance pension of the children conducting the internship under Art. 294, para. 1 of the Judiciary Act for the acquisition of legal capacity after graduation from a university majoring in "Law". In order to achieve the objectives of the research, a historical analysis of the social insurance legislation since the adoption of the Compulsory Social Insurance Code has been carried out, as well as a comparative legal analysis of normative acts regulating aspects of the education in the "Law" specialty, professional training, professional qualification, labour experience and professional experience, legal capacity, etc. Numerous arguments have been pointed out regarding the statement that the mentioned internship is not a part of the education period under the meaning of Art. 82, para. 1 of the Social Insurance Code, and the right-revoking legal fact regarding the payment of an inheritance pension in the analysed case is the graduation in the "Law" specialty.
