ON THE ISSUE OF PRELIMINARY CONTRACT OF ALLOCATION OF USE AMONG JOINT OWNERS

Summary/Abstract: The article deals with the possibility of concluding a preliminary contract of allocation of use among joint owners. A stance is also taken on the more general hypothesis, namely the one of admissibility of a preliminary contract where there exists no requirement regarding the form of validity of the final contract. Argumentation is given for the conclusion that a preliminary contract of allocation of use among joint owners has no practical value and, even if such a contract is concluded, it is actually a contract of allocation of use the effect of which the parties have stipulated on a condition or a term.
