Considerations Regarding the Quality of Secondary Passive Subject of the Local Policeman in Respect to the Crime of Assault

Summary/Abstract: The interaction of public administration and criminal law takes various forms; most of the times public officials are subject to crimes and they deserve special protection due to the nature of their job. But an accurate establishment of the facts and of the legal framework applicable is needed. The article debates whether or not the local policeman as described by law number 155/2010 can be a subject to the crime of abuse against a public official. This issue has provoked a serious debate that was finally ended recently, by a ruling of the Romanian High Court of Justice and Cassation.
