RECENT TRANSFORMATIONS IN THE FRENCH MODEL OF ADMINISTRATION

Summary/Abstract: French model of administration is, as in all West European democracies based on the Weber’s scheme. This scheme includes the following two principles namely: (I) the principle of subordination of administration to the political power; and (II) the principle of separation, namely of lack of unity between political power and the administration. (I)The principle of subordination in French theory finds its basis in article 20 of the 1958 Constitution. Due to the effect of tranismissian instruments which may be collegiate or solitary the principle of subordination is in the process of transformation. Transmission instruments consist out of the following services of the Presidency of the Republic: the General Secretariat the Cabinet, and the Special Adviser. The cabinets of ministers are characterized by the same role and elements of distinction. French public service is divided intofunctionares’ bodies, namely the communities of employees submitted to the same particular status. Some of these bodies are rather large. Such are for instance Financial Inspection, the State Council, and the Accountancy Court. These large bodies amount to a horizontal instrument of a strong effect and they transform the principle of subordination of administration to the political power into a system in which the administration acts more and more independently. (II) The principle of separation is also subject to change and departs from the Weber's scheme. Namely, French public servants enjoy a high degree o independence. They often engage into running for office and take part in politics. If they are not successful in their political carrier, they return to the public service. Departure from Weberian scheme of relationship between politics and administration has two consequences. The author thinks that such departure leads to the politicizing of administration, but also to the ever greater engagement of functionaries into the politics.
