Summary/Abstract: This report examines the basic principles that apply to the collection, storage and presentation of electronic evidence in criminal proceedings. The use of the basic principles is essential when examining digital evidence. Due to the lack of detailed regulation in the national legislation of the member states of the European Union, five basic principles have been adopted by the EU and the Council of Europe, which are used on an international measure – data integrity, audit trail, specialist support, appropriate training and legality.
