Resolutions establishing restrictions on night-time sales of alcoholic beverages intended for consumption outside the point of sale

Summary/Abstract: In March 2018, the Act amending the Act on Upbringing in Sobriety and Counteracting Alcoholism entered into force. Under it, municipal councils were empo- wered to establish, by way of resolutions, restrictions on the night sale of alcoholic beverages intended for consumption outside the place of sale. The article presents the requirements to be met by resolutions in the light of regulations and jurisprudence. The main goal of the author is to signal problems in the exercise of powers by municipal councils. The main conclusion of the study is as follows: the effective implementation of the Act’s objectives depends on the legal awareness of local government bodies.
