Summary/Abstract: In Romania, people with intellectual or psychosocial disabilities did not have the right to marry, divorce, be parents, adopt children and could not access a bank loan. According to the law, many of these people have been banned by the courts. The current legislative reform in the field emphasizes the degree of autonomy of the protected person, respect for specific needs, will and wishes. Currently, we are witnessing a new, modern legislative approach, in accordance with the needs felt at the social level, as well as in the practice of the courts, in harmony with the international and constitutional requirements in the matter.
