АBSURD POSITION OF THE SR OF SERBIA-IN A YUGOSLAVIA BEING MADE SENSELESS

Summary/Abstract: Various aspects of Serbia’s position are discussed — historical, politicological, legal, etc. After pointing at basic prerequisites of a democratic organizing (status of a citizen, existence of a people as an entity of citizens, authentic public opinion), the author treats the issue of creation of „old” Yugoslavia in 1918. Particularly negative in this respect was the policy of the Comintern aimed at destabilizing and destroying that state. That policy also influenced the conception and action of the Communist Party of Yugoslavia between the two wars. However, in course of the 1941—45 national liberation struggle, the Party succeeded to create new federative Yugoslavia and effect revolution with all of its peoples. In such a way this state became a positive reality permeated with new concept of Yugoslavia. Development of new socialist order was prompted by the conflict with Stalin in first post- -war years, as well as by the system of self-management. A prosperity period followed, marked by the 1963 Constitution, the best Yugoslavia ever had. Unfortunately, a period of nationalistic reconstruction of the SFR of Yugoslavia followed, bringing about many negative consequences. By 1968 and 1971 constitutional amendments great changes were introduced causing the creation of „national” states and a progressive weakening and dismembering of Yugoslavia. The process was completed by the 1974 Constitution, which was entirely unsuccessful, first of all because of dismembering the state of SFRУ and its transforming into an apparent federation, namely genuine confederation. Due to the delegate system in all fields, the system of consensus in decision-making, and of the right of veto in almost all areas of political and state activities, Yugoslavia became particularized, lost the basis of unity, suffered autarchic economy, politics and culture. The very constitutional order made possible unhindered deepening of the crisis, so that the country was on its way of backward movement. According to all indices the country is in a deepest crisis, so that not only the question is raised of its functioning, but of its very existence, too. Due to erroneous policy Yugoslavia was pushed back in development considerably. All basic values are practically shaken, which is visible also in untamable and absurd constitutional solutions according to which the SR of Serbia was transformed into an unheard of creation, which can not survive as such. In its framework, namely, there exist two so-called autonomous provinces — Voivodina and Kosovo, and they are raised to the level of federal units, so that Serbia is broken into three unequal parts. Most peculiar is the fact that Serbia is placed under à kind of guardianship not only by the Federation, but also by other republics and its own two provinces! Further elaborated are historical.background of such impossible solutions and corresponding practical consequences. There exists in Kosovo now a nationalistic and chauvinist regime oriented towards Albania, and it has applied for decades, and particularly after 1974, a systematic and specific genocide against Serbs and Montenegrins (violence, destroying of property, rape, depriving of elementary rights and freedoms), which amounted to mass migration and expelling of these peoples from Kosovo. It is absurd that Serbia did not have any legal possibilities to protect own population, in its territory. Ethnical composition in Kosovo is rapidly changing at the detriment- of mentioned peoples, althought this, territory has been throughout history the cradle of Serbian people, and of its medieval state, and also the place of the famous defeat from Turks. Albanian chauvinists and separatists, to quite a degree, due to the overall. situation in the country, constantly apply a policy of an „ethnically pure Kosovo”, which includes immigration of hundreds, of thousands so-called immigrants from Albania. The plan of creating „a great Albania” is also fulfilled by taking away of Kosovo through the population explosion characteristic for Shiptars namely Albanians, their birth rate being among the highest in the world. Ruling structures of power at all levels follow an anti-Yugoslav and anti-Serbian policy, which amounts to principal form of endangering and destroying integrity and security of the SFR of Yugoslavia as a state. This, of course, is negative for Serbia, too. Therefore all measures aimed at preventing the above sinister plans are legitimate, which applies to effecting all necessary constitutional changes — first of all in order to eliminate the existing absurd situations.
