Summary/Abstract: The whole world is going through an extraordinary period that is unprecedented but that can be easily compared to the catastrophes of the last century. From the first information we had about the new Coronavirus, seemed annoying and dangerous, without thinking, perhaps, about the magnitude that would take. The classification of COVID-19 as a pandemic did not necessarily mean at the beginning, an extremely high mortality rate but rather a global recognition of this virus. During the state of emergency, our legal and social order in the country had to comply with the effects of new legal instruments of legislation, named military ordinances. Citizen’s rights and freedoms are guaranteed by the Constitution, the exercise of certain fundamental rights or freedoms may be restricted only by law and only if a legitimate aim is pursued. In order to be able to be within constitutional limits, the restriction must be necessary, appropriate, non-discriminatory and temporary in order not to lead to the suppression of the right of freedom.
