Summary/Abstract: The article discusses the construction regulated in the provisions of Article 152 of the Administrative Procedure Code concerning the suspensive effect within the framework of resumption of administrative proceedings. The paper focuses on the premise, form and effects of issuing a decision in this course of action. The current regulation was analyzed and de lege ferenda postulates were submitted. The analysis is based on the doctrinal works and the decisions of the administrative courts.
