Summary/Abstract: The paper examines the prerogatives of the authorities during the state of emergency, the place occupied by the administrative acts issued or adopted during this period in the Romanian law system and the legal nature of these acts. Also, a number of related issues are addressed, such as legislative delegation, the legal nature of the Parliament’s approval of the state of emergency and the constitutional legal conflict between the President and the Parliament. On the administrative litigation side, the question arises whether the pre-trial administrative procedure was designed to challenge the normative administrative acts whose effects are conditioned by a certain term.
