Examination of the legislative amendments brought according to Law no. 212/2018 relating to the special enforcement procedure regulated under Law no. 554/2004

Summary/Abstract: The analysis of the amendments recently made to the provisions of art. 24 and 25 of Law no. 554/2004 under Law no. 212/2018 concerning the issue of enforcement of the judgments in the administrative and fiscal matter, especially from the point of view of the need for their adoption and correlation with the pre-existing legal provisions, turned out to be both current and useful. The article describes the main problematic aspects of the new amendments, showing that the inaccuracy characterising the new legal framework of the special enforcement procedure of seizure and the absence of the transitional rules shall generate various interpretations and too different solutions. That is why the new provisions have to be amended again, in order to meet the clarity and predictability needs, which are proper in the administrative and fiscal matter.
