Summary/Abstract: After the End of the former totalitarian systems of the leading role of the kommunist party is folowing a foundation of the basical constitutional changements. New Constitutions has been adopted as a result of a new foundied democracies. Therefore, we can constate a concrete model of the constitutional changements as a form of the clasical democratical systems (s.c. west democracies). In the framework of this model we can present for al next substantial new institutions: parliementary form of the executive power, the political pluralismus founded on the competitive demokracy, a democratical electoral system, and constitutional model of the separation of the powers. New democratical countries were also founded on the basis of a new role of the legal system, as a new system of the fair trial based upon administrative and constitutional judiciary. Also, the constitutional development of the Czech Republic is presenting an original mode of the Construction s.c. of the „Constitutional State“.
