Summary/Abstract: On 19th November 2015, the long waited Law on correspondences vote vas published in the Official Journal, with a hope that it will fix some sharp problems of the Romanian election process. The Presidential Election from 2014 brought into the public opinion some of them, latent or even hidden before. The image of Romanian citizens from abroad having difficulties to exercise their fundamental right to vote, staying in line for hours in front of the Romanian embassies/consulates or even worst, being dispersed with water for protesting – is a shameful democratic experience for our country. Fact is that it leaded to a political mobilization for the adoption of the current law. The comparative approach is very important for a national legislator, when introduces a new institution or democratic procedures. In this regard, we will analyse several European experiences, which could have been extremely useful for overcoming the legislative or technical problems of the Law on correspondency vote. In the end of our study we will focus on the main criticable provisions of the law on correspondences vote, we will analyse the changes brought to them during the legislative process and we will envisage our perspective for their improvement in the near future, in order to make this law efficient, to increase the quality of the democratic process and to simplify the access to the polls.
