Summary/Abstract: Currently, the transfer of virtual assets is outside the legal regulatory domain of the European Union regarding financial services. This fact exposes holders of crypto-assets to the risk of money laundering and acts of financing terrorism, as money of illicit origin can constitute the necessary flow for the transfer of crypto-assets, thus degrading the integrity, stability and reputation of the financial sector and threatening, equally, both the internal market of the European Union and the international consolidation of such transfers. The European Union's constant concern for combating money laundering and terrorist financing has materialized in recent years in the development of a set of rules that can constitute an effective regulatory framework for crypto-asset markets (MiCA), both to protect consumers, investors, as well as for maintaining financial stability in the Union. It aims to establish a public register of non-compliant crypto-asset service providers and provide for the general obligation to declare information on the environmental and climate footprint, without the MiCA project overlapping the anti-money laundering provisions, in relation to the new updated rules on fund transfers.
