Summary/Abstract: The Romanian Constitution recognizes and creates the normative framework regarding the role of the judiciary in upholding the principles of the rule of law and in resolving disputes by applying the law to specific cases brought before the court. From the point of view of the judicial organization, we must start from the delimitation of the judicial function from the other fundamental functions of the state: legislative and executive. The judiciary does not act in its own name, exercising its powers on the basis and within the limits conferred by legal provisions, and an independent and efficient judiciary is the function of the rule of law.
