GUARANTEES OF THE RIGHT TO A FAIR HEALTH

Summary/Abstract: Fair trial In the Turkish Legal System, that is, in the Constitution, it is stated that "Everyone has the right to a fair trial with claim and defense as a plaintiff or defendant before the judicial authorities by making use of legitimate means and means". Fair trial is an important phenomenon that ensures trust in justice. In this study, what fair trial is, the Universal Declaration of Human Rights, the European Convention on Human Rights and its place and importance in national law are mentioned. In the first part, the concept of fair trial is discussed. In the Second Chapter, the “Guarantee/Assurance” law presented to the individual about the “Fair Trial” has been discussed in the national and international legal system, and in the conclusion part, determinations have been made regarding the fair trial.
