Summary/Abstract: The aim of the paper is to present the issue of an unconditional reflex on the example of road incidents, in particular road collisions and accidents. There is no doubt that road traffic is a matter in which reflexes can carry a particular risk of dangerous situations. The study presents the most important issues related to the principles of criminal liability in the Polish law, including the concept of an act, introduces the legal and psychological aspects of unconditional and conditional reflexes, and gives examples of criminal cases in which the question of the unconditional reflex was analyzed in relation to the liability of perpetrators of road crimes. The discussed matter was supplemented with selected civil cases for damages and compensation for physical injuries and material losses suf- fered as a result of road accidents in which the suspicion of reflexes in the defendants also appeared.
