Summary/Abstract: The article deals with the new binding role of rulings in Italian law system, in particular concerning the administrative appeal trials. It first summarizes the statutes, which have altered the previous conformation of judiciary system, and the evolution of the relationship between law and judges. It then analyzes the rulings concerning security costs and tries to evaluate how the binding ruling (stare decisis) has affected Italian public tender market.
