Discussion on the Bill on Administrative Justice in the National Assembly

Summary/Abstract: The article traces the history of preparation of the first law on administrative justice in our country.Particular attention is given to the formation and activity of the commission tasked with drafting of the Bill. Disclosure is made of the different views of its members regarding the nature and organisation of administrative justice and the compromise reached with respect to the place of the court, namely that the latter should be subordinate to the Council of Ministers. The focus is put on the discussion in the National Assembly, the unanimity shown by the representatives of all parliamentary groups regarding the need for and the benefit of introducing administrative justice in the country, and the disputes on the new court’s jurisdiction, its constitutionality and structure.
