Observations about the status of complementary and alternative medicine in Polish law

Summary/Abstract: Complementary and alternative medicine are therapeutic methods not included in academic (conventional) medicine. In recent years, there has been a noticeable increase in the demand for this kind of paramedical services. In Poland, they have no separate legal regulation and the refore it is not clear whether they should be regarded as ‘ordinary’ or medical services. The aim of the article is to indicate the legal basis for the functioning of paramedical activity, define the subject of this paramedical activity, determine how the legal position of its recipients is shaped and to essay to predict the direction of possible changes. The article describes the genesis of paramedical activity, attempts to regulate some of its branches, the tendency of some international organisations to unify its status, the attitude that the medical and pharmaceutical self-governments take towards paramedicine in internal acts (regulating the principles of practice of the profession by its members). Using the available literature on the subject and making reference to the relevant doctrine and jurisprudence, the author analyses the current legal situation, which leads to presentation of proposals for the content of a legal definition of paramedicine and other postulates de lege ferenda resulting from the application of dogmatics of lawin the civil research method.
