The Definition of the Range of Crimes whose Perpetrators should have their DNA taken for the Purpose of their Future Identification and the Determination of the Retention Period of the DNA Profile stored in the National DNA Database

Summary/Abstract: The article deals with the definition of the range of crimes whose perpetrators should have their DNA taken for the purpose of their future identification and the determination of the retention period of the DNA profile stored in the National DNA Database for persons accused or suspected of committing an intentional crime, and for those serving a prison sentence for committing such a crime in respect of the relatively recent proposal to repeal the part of the Act on the Police of the Czech Republic relating to the collection of biological samples. The main objective is to evaluate the current legislation, weighing the legitimate objectives against each other, proposing the de lege ferenda and evaluating the decision Pl. ÚS 7/18.
