Qualification of contracts – a topic for reflection

Summary/Abstract: The qualification of contracts is, at this stage of the doctrinal research, rather a topic of reflection and analysis, than an already deepened topic. Qualification of contracts is a topic usually abandoned at the border between the subject of obligations and that of contract law. The compromise solution that was reached is to leave the entire analysis to the practitioners, on a case-by-case analysis. Still, practitioners need theoretical instruments in order to qualify a contract, and thus the circle closes without an acceptable solution.
