THE NOUVELLE ON PENAL CODE OF 2004 – ONE MORE STEP TOWARDS MODERN EUROPEAN PENAL LEGISLATION

Summary/Abstract: The author of this article is presenting and analyzing the most significant changes and amendments to the Penal Code of the Republic of Macedonia, made in the most recent Nouvelle enacted in March 2004. Since there are numerous changes, this article has been divided into two parts. Part one overviews the changes of and amendments to the general part of the Penal Code, whereas the second part outlines the changes related to the special part. General observation of the author is that this (so far largest) Nouvelle of the Penal Code, is an overall successful legislative move, since among other, it represents a big step towards the harmonization of the Macedonian penal legislation with the modern European penal legislation.
