Summary/Abstract: Purchases of goods and services by public administration units, through procedures defined through public procurement, represent a significant share of gross domestic product (GDP). Public procurement is a key form of public sector participation in the economy and the use of social clauses and environmental considerations is a tool to shape this participation in line with EU and national policies. The creation of a public procurement system is primarily related to the activity of the state in terms of spending public funds. The assessment of social clauses and environmental aspects indicates that it is an important instrument for the development and support of a social economy. The purpose of this article is to analyze whether the new law contains provisions that enable effective and transparent public procurement, considering the role of public procurement in shaping state policy. It is also important to answer the question of whether the current Public Procurement Law also follows the guidelines of the Strategy for Responsible Development regarding public procurement.
