Summary/Abstract: The theories of criminalization, developed by Polish researchers, indicating the premises (stages) of the decision-making process regarding criminalization, do not directly refer to the specificity of crime against children. The purpose of this article is to confront contemporary criminalization assumptions with a particular situation when it comes to infringing or endangering the child’s welfare. This is because child victimization differs significantly from adult victimization on many levels. The consequences of criminalization itself are also more severe for the child victim. As a result of such an analysis, additional premises were developed, which should always be considered when considering the introduction of criminalization, maintaining criminalization, or decriminalizing harmful behaviour for a child.
