Practical application of the test of the specificity of legal provisions in assessing the constitutionality of provisions regulating the principles of dismissal of members of the Social Dialogue Council

Summary/Abstract: In this study, which is based on the position of the Sejm regarding a case pending before the Constitutional Tribunal, the analysed provisions are confronted with the principle of the specificity of legal provisions. The content of this principle is indeterminate, and the test of the specificity of legal provisions, which is a tool for assessing compliance with the principle in question, leaves a significant interpretative margin to the Constitutional Tribunal. The Tribunal’s ruling on the incompatibility of legislation with the principle of the specificity of legal provisions should be a measure of last resort, applied when other interpretative methods are insufficient. This is not the case in the case in question.
