Summary/Abstract: In this field, public international law has postulated principles that have been interpreted antagonistically by states as positioning themselves as investment exporters or importers of investment, or North states to South states. Regarding the international law of foreign investments, the analysis in this study starts from several basic principles, with universal applicability in the analyzed subject: the principle of freedom of forms and methods of investment, the principle of free access of foreign investments in all areas of economic life, the principle of non-discrimination between investors belonging to the host state and those belonging to the investing state. Usually, the most prestigious bank in a state is the one empowered by the government with competences (guarantee management) in terms of guaranteeing foreign investments, these being mostly banking financial bodies.
