Summary/Abstract: The right to property is part of the category of civil rights, along with the right to life, the right to liberty, the right to equality before the law, equality in rights between men and women, etc. The property right is a fundamental right regulated in article 44 paragraph (2) of the Romanian Constitution, which specifies that “private property is guaranteed and protected equally by law, regardless of the owner”, and art. 44 (3) provides that the expropriation can only be carried out for a cause of public utility and with a fair and prior compensation. The Civil Code, in art. 555 para. (1), defines private property as “the right of the owner to own use and dispose of an asset exclusively, absolutely and perpetually, within the limits established by law”.
