Summary/Abstract: This article examines the ways in which the European Court of Human Rights, in applying the principle of the presumption of innocence, relates to the incidence of the autonomous notion of "criminal charge". The aim is to establish when the presumption of innocence begins to apply when it is found to have been infringed and to clarify the various issues of applicability.
