Summary/Abstract: This article is an attempt to distinguish between the concepts of ‘freedom of expression’ and ‘hate speech’, highlighting their main elements. Some of the international documents in which they are mentioned are also discussed. It is pointed out that despite the frequent use of the term ‘hate speech’, there is no generally accepted definition in the theory. Some characteristics have been commented, that derived from the discussion held by researchers and experts, as well as from the case-law of the European Court of Human Rights.
