Summary/Abstract: Over the past year video surveillance in the election process has aroused considerable public interest, especially among political scientists and journalists. This will be evident in the next 2023, when general local elections are to be held. With respect to that issue, some controversial points from a legal point of view are discussed, as well as a proposal on how some concepts should be perceived from a practical point of view.A thorough review of the competence of the election administration and its acts regulating video surveillance is presented, as well as relevant case law on the issue.The timeliness of the article is connected to the expected ruling of the European Court of Justice in Luxembourg on a preliminary ruling on whether Regulation 2016/679 (EU) applies in respect of elections in the country and to what extent the individuals can protect personal data in the election process. Improving the legislation on video surveillance during elections is also proposed.
