THE OBJECT OF THE ACTION FOR ESTABLISHING FACTS IN LITIGATION PROCEEDINGS

Summary/Abstract: This kind of action with court is only an instrument for establiching the existence or non-existence of certain right or legal relationship, the only exception being establishing the truth regarding a certificate (document), namely establishing the existence, or non-existence, of a legal fact. The issues connected with the object of the action for establishing facts in litigation proceedings are reviewed both in terms of domestic and comparative laws, while some controversial issues are completed by author’s own considerations and assessments - de lege lata and de lege ferenda.
