Summary/Abstract: The individual constitutional complaint is a concept whose history can be traced back to the German Reich and Austria-Hungary from the middle of the 19th century. Due to the growing importance of the protection of human rights, after the Second World War, access to constitutional courts was also opened to individuals in the name of protecting their fundamental rights. In Bulgaria, the debate "pro" and "contra" the introduction of the individual constitutional complaint has been ongoing for thirty years without leading to specific regulatory solutions. The present study provides a brief overview of the history, comments on the specific regulatory challenges facing the legislator in case he demonstrates the will to introduce the concept into Bulgarian law and suggests a possible, more active role that the Constitutional Court would play in the protection of human rights.
