Summary/Abstract: According to Bulgarian law, if the accused or the victim does not reside in the country and does not have a Bulgarian address by which could be summoned, they can not enjoy all the rights provided by the law. Moreover the victim does not have the right to take part in the procedure if resides abroad even in a member country. This legal situation is contrary to European law which prohibits any form of discrimination based on nationality.
