TYPES OF INVOLUNTARY MOTIVES OF CRIMINAL OFFENCES

Summary/Abstract: The author distinguishes between three types of motives of criminal offences appearing in judicial practice, namely: (a) involuntary motives in restricted sense, where the perpetrator is unable to state any data concerning the resons for committing the criminal offence; (b) erroneously interpreted motives, where there is unconscious rationalization of genuine motives; and (c) inadequate motives, where the inducement and the degree of seriousness of the criminal offence are in open conflict. The author analyzes various forms of appearance of the basic types of involuntary motives of criminal offences, while pointing out at causes of their origin. This is illustrated by examples of judicial practice, and followed by elaboration of ways of determination in this matter in criminal proceedings.
