Ownership vs access in terms of sustainable public procurements

Summary/Abstract: The aim of this article was to examine whether local government units, which constitute the largest group of public procurers in Poland, award sustainable public procurements, in which they emphasize access to goods as a substitute for property. The empirical study was carried out using an electronic questionnaire, which was sent to all n = 2,807 local government units. N = 1041 responses were received, which is 37% of the studied population. Based on the responses received from local government units, an economic analysis of the amended public procurement law was carried out in terms of supporting public contracting authorities in sustainable public procurement. As a result of the economic analysis of public procurement law, it is recommended to promote good practices among public contracting authorities in the scope of each time considering, as part of the analysis of needs and requirements, whether award the tender for access to goods/services.
