Judicial conventions pursuant to the new Code of Civil Procedure

Summary/Abstract: The procedural “ritual” specific to “public service” – just as that performed by Justice – is sometimes compatible, either totally or sine modo, with certain conventions of the parties in a lawsuit, mainly aiming at the trial procedure and the judgement. Such a possible convention evokes the pacifying function of the trial and, at the same time, challenges the mutual interest of the parties in rapidly finding the appropriate solution to their legal dispute.
