Summary/Abstract: The commentary, on the basis of the relevant case law of the Court of Justice of the European Union, analyzes whether and in which cases Member States may be required to apply the provisions of an EU directive directly in criminal proceedings instead of national law, i. e. the possibility of direct application of directives is being discussed.
