Summary/Abstract: The criminal penalty should, by definition, perform several basic functions, among which an important place is given to the function of preventing against reoffending. From this perspective, it is synonymous with its effectiveness. Thus, such forms of punishment have been searched for that actually guarantee that the convicted person will not return to criminal activity. In 2007 the possibility of placing the offender under the supervision was introduced. Accordingly, it can be acknowledged that this practice is relatively new, as compared to the execution of other penalties. There are plenty of issues concerning ESS that have not been disclosed yet. Therefore, studies have been undertaken with reference to the convicted persons placed under the electronic supervision in the past and those not placed in order to reveal their attitude towards the effectiveness of ESS. As part of research, a diagnostic survey method has been employed, in addition to author’s own survey questionnaire. There were 200 convicted men who participated in research, half of whom were under electronic supervision due to an earlier court decision. The obtained research results point to a significant similarity of the attitudes of the compared convicted persons as regards the way the electronic supervision is understood and the types of factors influencing its effectiveness. Nonetheless, the convicted persons having no experience with ESS perceive more drawbacks in such a supervision in comparison with the persons who have experienced ESS, which may prove that their assessment is entrenched in stereotypes. It is worrying that convicts do not feel considerable burden caused by electronic supervision, which may imply the lack of its effectiveness in their case.
