Summary/Abstract: This paper addresses the fundamental concepts of the Proposal for a Succession Regulation. Special attention is paid to the novelties in the field of applicable law as well as to the impact of this European legislation proposal on the new private international law of Montenegro and Serbia. It is suggested that the Proposal for a Succession Regulation is very innovative and liberal, its main features shifting from nationality and lex situs towards habitual residence as the most important connecting factor and fostered party autonomy. The new legislation of Montenegro and Serbia are significantly influenced by the Proposal for a Succession Regulation.
